Simpson, P.E., Assistant State Engineer <br />SUBJECT: West Sunday Mine -Union Carbide Corporation -San Miguel <br />County #81-21, Application for Mining and Reclamation Permit <br />As requested by your oi'fice, we have reviewed the application for an under- <br />ground uranium and vanadium mine near Naturita. The applicant states that <br />some water will be enc~DUntered in the underground workings of the mine and <br />that underground sumps will be provided to store this water. The applicant <br />also states that this seep water will be used for underground mining and <br />drilling requirements. We view this use of ground water as putting the <br />ground water to beneficial use which requires a permit to use ground water <br />in oirler to not be in violation of CRS 1973, 37-90-137. Until this permit <br />has been obtained, the applicant will be in violation of the above referenced <br />statutes . <br />The applicant also status that any excess water that exceeds the underground <br />capacities would be pumped to the surface and impounded in a series of evap- <br />oration ponds to be loc~ited and constructed at some later date as they are <br />required. The applicant would have to obtain storage rights from the Division <br />7 Water Court in Duran<Io prior to construction of these ponds. If any dams <br />that will be constructed will be over 10 feet in height from the lowest point <br />in the valley floor to the bottom of the spillway, the design must be approved <br />by this office in order to be in accordance with Article 87 of Title 37 of the <br />1973 Colorado Revised Statutes. <br /> <br />\, We have no objections to the application as long as the applicant obtains the <br />needed permit and in the future if necessary obtains the necessary storage <br />rights. <br />6. <br />al D.
