<br />For any ponds that Colowyo may operate in the
<br />future as treatment ponds, consistent with Colorado
<br />Division of Minerals and Geology design criteria,
<br />any manual dewatering of such treatment ponds
<br />must meet primary dischazge limitations."
<br />Vehicle wash water and/or pit pumpage will only be dischazged through Outfalls
<br />0026, 0046, 0076, 0086, 0096, and Ol Ob.
<br />5. In our opinion, it is very cleaz when the Altemate Limitations apply.
<br />The Altemate Limitations found in Part I,A.I.a. apply to Outfalls 001, 002a, 003,
<br />004a, 005, 006, 007a, 008, 009a, and O1 Oa when any discharge, or increase in the
<br />volume of a dischazge, is caused by precipitation within any 24-hour period that is
<br />less than or equal to the 10-year, 24-hour precipitation event (or snowmelt of
<br />equivalent volume) or greater than the 10-yeaz, 24-hour event (or series of storms
<br />or snowmelt of equivalent volume). The application of these Altemate
<br />Limitations aze subject to the Burden of Proof requirements described in Part
<br />I,A.2. This is the same language found in Colowyo' s current General Permit No.
<br />COG-850017, Part I,B.I .a.

<br />When a precipitation event e~,q than the 10-yeaz, 24-hour event occurs or
<br />snowmelt of the equivalent volume is entering a pond, Colowyo is eligible to
<br />waive total suspended solids (TSS) and total iron limitations and use the
<br />Altemate Limitations found in Part I, A.I.a. and b. for the dischazge. This applies
<br />within 48 hours after a precipitation event has stopped or 48 hours after pond
<br />inflow from snowmelt has stopped. The caveat with Part I,A.I.b concerning
<br />Outfalls 0026, 0046, 0076, 0086, 0096, and OIOb currently requires the majority
<br />of the dischazge to consist of surface runoff. Refer to the Burden of Proof
<br />Requirements found on Page 5, Part I, A.2.a. However, as mentioned above,
