These dischazges aze eligible for the Effluent <br />Limitations of Part I.A.I.a. which includes both the Primary Effluent Limitations <br />and the Altemate Limitations. <br />Outfatls 0026, 0046, 0076, 0086, 0096, and 0106 represent dischazges consisting <br />of vehicle wash water or pit pumpage mixed with surface runoff that may not <br />meet the Effluent Limitations of Part I.A.I.a. These discharges aze eligible for the <br />Effluent Limitations of Part I.A.1.6. which includes both the Primary Effluent <br />Limitations and the Altemate Limitations. Again, for Outfall 0026 the limitations <br />found in Part I.A.I.b. apply only if the discharge consists of vehicle wash water <br />and surface runoff. The limitations of Part I.A.I.b. only apply at Outfalls 0046, <br />0076, 0086, 0096, and OIOb if the dischazge consists of pit pumpage and surface <br />runoff. Colowyo has proposed language to clarify the draft permit requirement <br />that Alternate Limitations apply only if the a'ori of the dischazge consists of <br />surface water. Here, the issue should not be what portion of the dischazge is made <br />up of what source water, but whether the vehicle washwater/pit pumpage caused <br />the exceedance of the Primary Effluent Limitations. Colowyo proposed revised <br />language for the new draft Permit NO. CO-0045161, page 5, Part I,A.2., Burden <br />of Proof Requirements: <br />"Relief shall be granted only when necessary. <br />Outfalls 0026, 0046, 0076, 0086, 0096 and O1 Ob aze <br />not eligible for this exemption unless the permittee <br />can demonstrate that surface runoff caused the <br />exceedence of primary limitations. This can be <br />demonstrated by evidence that any pit pumped <br />water in the pond met the primary limits before it <br />was dischazged into the sediment pond." <br />Similazly, Colowyo proposed the last pazagraph in this section to be revised as follows: <br />"All of Colowyo's ponds aze currently operated as <br />containment ponds.
