outflow from discharging sediment control ponds. The installation of these
devices is scheduled for the Spring of 1998 and is weather-dependent.
4. For clarification purpose ~~ k ~ !~'C \~ ~ t P•T ~~
5t ~,/~,,c ewh„~f &~~` S~" ~° ~yfV v~.~ ~{,r ,~~~J~
Outfalls 001, 002a, 003, 004a, 006, 006, 007a, 008a, 009a, and Ol0a represent
dischazges consisting solely of surface water runoff, except Outfall 001 which
may include groundwater. These dischazges aze eligible for the Effluent
Limitations of Part I.A.I.a. which includes both the Primary Effluent Limitations
and the Altemate Limitations.
Outfatls 0026, 0046, 0076, 0086, 0096, and 0106 represent dischazges consisting
of vehicle wash water or pit pumpage mixed with surface runoff that may not
meet the Effluent Limitations of Part I.A.I.a. These discharges aze eligible for the
Effluent Limitations of Part I.A.1.6. which includes both the Primary Effluent
Limitations and the Altemate Limitations. Again, for Outfall 0026 the limitations
found in Part I.A.I.b. apply only if the discharge consists of vehicle wash water
and surface runoff. The limitations of Part I.A.I.b. only apply at Outfalls 0046,
0076, 0086, 0096, and OIOb if the dischazge consists of pit pumpage and surface
runoff. Colowyo has proposed language to clarify the draft permit requirement
that Alternate Limitations apply only if the a'ori of the dischazge consists of
surface water. Here, the issue should not be what portion of the dischazge is made
up of what source water, but whether the vehicle washwater/pit pumpage caused
the exceedance of the Primary Effluent Limitations. Colowyo proposed revised
language for the new draft Permit NO. CO-0045161, page 5, Part I,A.2., Burden
of Proof Requirements:
"Relief shall be granted only when necessary.
Outfalls 0026, 0046, 0076, 0086, 0096 and O1 Ob aze
not eligible for this exemption unless the permittee
can demonstrate that surface runoff caused the
exceedence of primary limitations. This can be
demonstrated by evidence that any pit pumped
water in the pond met the primary limits before it
was dischazged into the sediment pond."
Similazly, Colowyo proposed the last pazagraph in this section to be revised as follows:
"All of Colowyo's ponds aze currently operated as
containment ponds. Such ponds shall be considered
to have only manual dewatering capability and
relief under the atemate limitations provision shall
