UIVIJ~UN OF MINES <br />LEAS E <br />THIS AC,I~~NT, made in duplicate this 25th day of April, 1974, <br />between Chazles E. Hogue and Margaret E. Hogue, parties of the first <br />part, and Cecil E. Bettger and Kenneth D. Bettger, parties of the second <br />Part; <br />WIT[~SSETH, Whereas, the parties of the first part own a tract of <br />land described as follows: <br />A gravel pit located on first parties' land about six <br />miles West of Steamboat Springs, Colorado and North of <br />U.S. Highway 40, Routt County, Colorado. <br />NOW THEREFORE, in consideration of the rental hereinafter provided, <br />the first parties do hereby lease and let unto second parties said Gravel <br />Pit above-described for the purpose of obtaining gravel for a period of <br />one year ca~miencing Jame 1, 1974 and ending June 1, ]975, with option of <br />second parties to renew said lease for one additional year by giving <br />first parties sixty (60) days written notice of renewal and the rate per <br />cubic yazd shall be negotiated. <br />It is provided that during the teen of this lease, said parties of <br />the semncl part shall have the exclusive right to obtain gravel from the <br />above-mentioned pit. <br />It is further provided that as a rental, said parties of the first <br />part shall receive twenty-five cents (25 cents) per cubic yazd for all <br />gravel removed which shall be paid quarterly during the term of this lease. <br />Parties of the second part agree to keep correct records of all gravel <br />removed. <br />IT IS AGREED AND UNDERSTOOD, that second parties will be responsible <br />for all costs and liabilities in the operation of the removal of said <br />gravel and shall hold first parties harmlaas from any liability. <br />Second parties agree to shut gates to protect livestock of the first <br />parties, which it is agreed may be grazing about said premises, and will <br />not injure said livestock. <br />IT IS FURTHER AGREED, that on tar+++ination of this lease, second <br />parties shall remove all their marhinary and equipment fran said premises. <br />IN WTTNESS WHEREOF, the parties have hereunto set their hands and <br />seals the day and year first above written. <br />' ~C~~ ... <br />Cecil E.
