Dear Ms. Marek:
By this letter Wyoming Fuel Company (WFC) is responding to
the compliance requirements of paragraph 4 of page 4 of the
Notice of Violation, Cease and Desist Order and Clean-Up Order
(the "NOV"), issued to WFC on April 5, 1988. Paragraph 4
requires a written plan describing the immediate and long-term
measures which WFC proposes to comply with the Act and
regulations promulgated thereunder. The proposed immediate and
long-term measures were discussed in detail with you and other
Colorado Department of Health representatives on Tuesday, April
26, 1988. It is our understanding that, subject to working out
the details regarding sludge handling in Pond 002, the detailed
measures discussed on April 26 will be incorporated by the
Division into a schedule of compliance which will then be
incorporated into the NOV. wFC is proposing the following
measures be taken in order to maintain compliance with the Act
and regulations.
Short-term Measures
Short-term measures include a two-phase Demonstration
Project whereby WFC will utilize either or both Ponds 002 and 003
for increased settling capacity and determine the effectiveness
of chemical treatment, if necessary. During Phase I, the mine
water discharge will be split so that either or both Ponds 002
and 003 can be used for settling (Pond 003 is presently a
sedimentation pond for storm runoff). This effort will increase
pond residence time for mine discharge to enhance settling of
suspended solids. In the event resulting discharges from Ponds
002 and 003 meet total suspended solids (TSS) effluent limits per
our current NPDES permit for discharge point 002, as determined
by the specified monitoring program, then WFC will continue to
use either of both Ponds 002 and 003 until the long-term solution
described below is in place.
