Paragraph 4 <br />requires a written plan describing the immediate and long-term <br />measures which WFC proposes to comply with the Act and <br />regulations promulgated thereunder. The proposed immediate and <br />long-term measures were discussed in detail with you and other <br />Colorado Department of Health representatives on Tuesday, April <br />26, 1988. It is our understanding that, subject to working out <br />the details regarding sludge handling in Pond 002, the detailed <br />measures discussed on April 26 will be incorporated by the <br />Division into a schedule of compliance which will then be <br />incorporated into the NOV. wFC is proposing the following <br />measures be taken in order to maintain compliance with the Act <br />and regulations. <br />Short-term Measures <br />Short-term measures include a two-phase Demonstration <br />Project whereby WFC will utilize either or both Ponds 002 and 003 <br />for increased settling capacity and determine the effectiveness <br />of chemical treatment, if necessary. During Phase I, the mine <br />water discharge will be split so that either or both Ponds 002 <br />and 003 can be used for settling (Pond 003 is presently a <br />sedimentation pond for storm runoff). This effort will increase <br />pond residence time for mine discharge to enhance settling of <br />suspended solids. In the event resulting discharges from Ponds <br />002 and 003 meet total suspended solids (TSS) effluent limits per <br />our current NPDES permit for discharge point 002, as determined <br />by the specified monitoring program, then WFC will continue to <br />use either of both Ponds 002 and 003 until the long-term solution <br />described below is in place. <br />In the event that either or both of the above described <br />discharges from Pond 002 and 003 do not meet the TSS limit per <br />
