No mining related dieturbaneee will occur within 100 feat of the outride line <br />of the right-of-way of Colorado State Highway 133 ae shown on Appendix I - Mep <br />1. The angle of draw used to protect the State Highway from subsidence will <br />be dictated by the approved CHLAD Mining and Reclamation Plan, (the estimated <br />angle of draw ie 25 degreeB). However, mining related dleturbancae may occur <br />if, after public notice and the opportunity for public hearing Sn the <br />locality, n written finding ie made by the Authorised Officer that the <br />interests of the public and the landowners affected by mining within 100 feet <br />of a public road will be protected. <br />B. A 1/8 mile buffer zone will be protected on either aide of the riparian zones <br />along the North Fork of the Gunnison Rivsr and in Hawkaneet Canyon (Appendix I <br />- Hap 2). No surface dleturbancae, except surface subsidence, will be <br />permitted within these buffer sense unless no feasible alternativa^ exist. <br />All unavoidable surface dleturbancae will require approval of the BLH'e <br />Authorized officer. Tha 8LM will coordinate with the Fleh and Wildlife <br />Service and the Colorado -ivision of Wildlife to determine the type and extent <br />of allowable varlencaa. <br />C. Power lines used in conjunction with mining of coal shell be constructed eo ae <br />to conform with the publication Suaaeetad uracticee for Raptor Proteetlon on <br />Power lines - The state of the Art in 1981, (Olendorff, et. al. 1981). <br />• D. Approximately 6.6 acres (Appendix I - Mnp 4) of the proposed lease tract are <br />located within the 100-year floodplain associated with the North Fork of the <br />Gunnison River. These lends are unsuitable for coal mining. <br />Because the review area ie crueiel winter range for elk (Appendix I - Map 3), <br />coal related fseilities and surface disturbances will be authorised in the <br />review area only if no feasible nlternetivee exist. Tha BLH will coordinate <br />with the Colorado -ivieion of Wildlife to determine the type and extent of <br />allowable variances. Coal exploration, facility construction, and major <br />scheduled maintenance will not be authorised within these crucial winter <br />ranges from December 1 through April 30. All unavoidable surface disturbances <br />within these ranges will require approval of the aLH's Authorized officer. <br />F. The construction of surface facilitisa shall be designed eo ee to avoid or <br /> mitigate all cultural resource sites especially SGN266. <br />G. Because the presence of Grand Mesa Penetemon hoe bean documented in Hawkenest <br /> canyon, a Threatened and Sndangerad plant survey will be required prior to any <br /> surface disturbance. <br />The following issuaa will be looked at during the mina plan stage: <br />A. with respect to bald or golden eagle seats which may 6a established on the <br /> review area during the ilia of the project, the following shall be applied. <br /> No new permanent surface facllitiea or disturbances shell be located within a <br /> 1/4 mile radius buffer Bone around each bald or golden eagle nest site. No <br /> surface activities will be allowed within s 1/4 mile radius buffer cone around <br /> each angle neat alto from March 1 to July 1. Any proposed activities in, or <br /> ndiacent to, these buffer cones (except routine maintenance) will require <br /> approval from the BLM, on a Bite-specific basis, after coneultatlon with the <br />• -.S. Fish and Wildlife service. _ <br />
