The following, numbered in accordance with the observations set <br />forth on Page 2 of the report, respond to those items: <br />2. The contaminated soil from the abatement excavation was placed on a plastic liner. This soil is being <br />run through the aggregate plant to process material suitable for use in producing asphalt pavement <br />mix from the on-site asphalt plant. On or about June 4, 2001, Jamie Gaboriau, Environmental <br />Manager of Aggregate Industries-WCR, Inc., contacted Bob Jorgensen of the Air Pollution Control <br />Division, Colorado Department of Public Health and Environment, and obtained his approval for <br />incorporating the contaminated soil into the production of asphalt on the site. <br />3. The fill material for the abatement excavation came from the overburden stockpile (berm) west of the <br />excavation, and from clean soil that had been removed from the abatement excavation. <br />Approximately eight (8) to ten (10) feet of clean soil was excavated above the contaminated soil, and <br />the clean soil had been stockpiled separately from the contaminated soil, <br />On June 13, 2001, Scott Rutherford of Paragon Consulting, spoke with Roger Doak of the Hazardous <br />Materials and Waste Management Division, Colorado Department of Public Health and Environment, <br />and Mr. Doak was in agreement with backfilling the abatement excavation and mining it out later. <br />4. Groundwater and free-phase product in the amount of 83,000 gallons was shipped by Key Energy <br />Services to Arvada Treatment Center for treatment and disposal. The additional groundwater that had <br />been pumped from the excavation, approximately 20,000 gallons, was used for dust suppression of <br />aggregate material as it was run through the asphalt plant.
