<br />5)The relationship of the topsoil stockpile and the excavated area is not clear; the Reclamation <br />Plan Map with its slope symbols suggests that the extraction will extend through the area of the <br />topsoil pile to the permit area boundaries. Rule 3.1.9 (3), however, requires that topsoil <br />stockpiles be located where disturbance by ongoing mining operations will be minimized. 6) The <br />~/ stock pond appears to be identically shown on both the Mining Plan Map and the Reclamation <br />F~ Plan Map and the Exhibit D narrative states that this pond will remain. Without the pit being <br />outlined on the map and according to the 3:1 slope symbols indicated on the Reclamation Plan <br />Map, it would appeaz that the stock pond will also be mined through. If the pond is mined <br />through and then reestablished, then the requirements of Rule 3.1.5 (7) regarding pond slopes <br />must be satisfied and a commitment made to do so. <br />The Exhibit E-Mining Plan Map should be revised to include the information and detail required <br />for the Exhibit as cited above. <br />EXHIBIT E-RECLAMATION PLAN MAP:11 The map does not show the gradients of the north <br />and east slopes of the pit, assuming that there will be such. 2)As indicated under the discussion <br />of the Mining Plan Map, the stock pond should not be represented on the Reclamation Plan Map <br />as it is on the Mining Plan Map if, in fact, it is mined through. If it is mined through and then <br />reestablished, then its slopes must meet the requirements of Rule 3.1.5 (7). 3)The 3:1 gradients of <br />the reclaimed slopes of the pit as presented on this map indicate that mining will be conducted up <br />to the boundaries of the permit area of the south and west sides. Hopefully, if this is the case, the <br />~ mining plan will be to mine down to a 3:1 slope rather than backfill several thousand feet of <br />~ highwall to achieve the required 3:1 slope. This is not made cleaz in the narrative under Exhibit <br />C. <br />1)The Exhibit E-Reclamation Plan Map should be revised to show the gradients of all of the pit <br />slopes. 2)The Reclamation Plan Map should be revised to show the pit outline. 3)The narrative in <br />Exhibit C and D should be revised to cleazly indicate if the stock pond will be mined through <br />and, if so, how it will be reestablished. 4)The narrative in Exhibit C should be revised to indicate <br />if the mining will be extended to [he mazgins of the permit area and, if so, whether the 3: I slopes <br />will be constructed in conjunction with the mining operation or through backfilling of a highwall <br />subsequent to the actual mining. <br />EXHIBIT I: Evidence has been provided of the receipt by the Pueblo County Clerk and Recorder <br />of a mailing from Kirkland Construction but the copy of the cover letter for this mailing included <br />in this Exhibit speaks of the material as the "Special (111) Operation Reclamation Permit <br />':~ Application Form".
