Mr. Donald Frick <br />August 15, 2005 ~!, <br />Page 2 i <br />this plan and made appurtenant to the tract of land where the gravel pit will be located, until a <br />permanent augmentation plan for the gravel pit has been adjudicated. The 52.5% interest <br />consists of a 21.55 percent interest owned by the City of Longmont and a 30.9 percent interest <br />owned by Aggregate Industries. According to the plan approximately 57.6 acres of ground <br />water would be exposed at the site if the site was abandoned and dewatering stopped, <br />representing a depletion of 148 acre-feet annually. The surface area that would be exposed <br />should dewatering cease is less than the area currently exposed at the site since several dikes <br />located between the existing ponds could be easily removed, thereby draining the water to the <br />eastern-most pond on the site. The 52.5% interest in the Coffin & Davis represents an annual <br />consumptive use credit of 172.2 acre-feet, therefore, the commitment is found to be adequate <br />to cover the depletions from evaporation that would occur if the dewatering process was <br />stopped. A copy of this approval letter and a copy of the stock certificate shall be recorded with <br />the Weld County Clerk and Recorder's Office. <br />A monthly breakdown of depletions and replacements is shown in the attached Table No. <br />2 that was submitted with your report. <br />I hereby approve this substitute water supply plan, in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: P <br />1. This SWSP shall be valid for the period of January 1, 2005 through December 31, 2005, <br />unless otherwise revoked, modified, or superseded by decree. Should a request for <br />renewal of this plan be needed, such renewal request must be submitted to this office by <br />September 30, 2005. ' <br />2. The total area of pond surface exposed after December 31, 1980 shall not exceed 67.2 <br />acres. Total consumptive use of the mining operation shall not exceed 190.35 acre-feet of <br />which 15.83 acre-feet is limited to water in product, 1.98 acre-feet is limited to dust <br />suppression, and 172.70 acre-feet is limited to evaporative loses. Should the total <br />consumption at the pit exceed these amounts prior to the expiration date of this plan, an <br />amendment needs to be filed with this office. <br />3. The Applicant shall provide daily accounting (including, but not limited to diversions, <br />depletions, replacement sources, and river calls) as required by the Division Engineer <br />for the operation of this SWSP. The Applicant shall provide accounting to the Division <br />Engineer and the Water Commissioner on an interval acceptable to the Division <br />Engineer and Water Commissioner. Accounting and reporting procedures are subject <br />to approval and modification by the Division Engineer. The Applicant shall ensure that <br />all required accounting is forwarded promptly to the Water Commissioner and the <br />division office to enab{e the administration of this SWSP. The Water Commissioner <br />responsible for the administration of this plan is Mr. Scott Edgar,1735 Dolores River <br />Drive Windsor, CO 80550, phone no. (970) 686-0628. <br />In addition, the applicant shall submit a report from each entity making replacements; for <br />this plan, that entity is the City of Westminster. The report shall include an accounting <br />of all wastewater plant water effluent controlled by each entity, showing the total volume <br />of water under its control at the various wastewater treatment plants;^ and the amount <br />committed to each of the recipients of the water. ', <br />
