<br />82-75 <br />Page 2 <br />In reference to paragraph 4 of the Hawea letter, a view <br />of the Mining Flan (Exhibit B) shows the Hawes property to <br />be substanially removed from the active operations area of <br />the Phoenix mine. <br />In reference to paragraph 5 of the Hawes letter, they <br />are suggesting that we intend to steal mineral contained in <br />their claims. We have no intention whatsoever to commit any <br />criminal actions. Attached is a copy of a letter from Clear <br />Creek County Sheriff James R. Bennett, dated April 21, 1982, <br />attesting to my honesty and integrity. <br />Pertaining to paragraph 6 of the Hawes letter, again we <br />have no intention of stealing any trees from the Hawes claims. <br />Please note that the Hawes claims, as are the rest of the <br />mountain areas, area prime cutting ground for firewood and <br />Christmas trees by the multitudes of wood-burners. <br />In reference to paragraph ~ of the Hawes letter, the <br />settling pond will not be readily visible from the county <br />road. The pond will be used as a de-watering facility and <br />should emit no noxious odors. The pond is well above the <br />Trail Creek drainage. Primary access to the Hawes claims <br />is by the county road, and will not in any way be affected <br />by this operation. <br />We intend to cooperate with the Hawes in any way <br />necessary, but do not feel obligated to incur the additional <br />expense of surveying their land. We have already established <br />the boundaries of our property. However, a more serious <br />problem exists on the Hawes and several adjoining properties, <br />that being beetle infestation of the trees and a serious <br />forest fire hazard caused by the beetles and the forest <br />needing thinning and grooming.
