~ III IIIIIIIIIIIII III ~
999
Po Box 537
Idaho Springs, CO 80452
April 21, 1982
Mr. Jay Lucas
Reclamation Specialist
Mined Land Reclamation Board
1313 Sherman Street
Denver, CO 80203
RE: Phoenix Mine Limited Impact Application (82-75)
Dear Jay:
In respon:;e to letters of comment from Alice A. Hawes
(Mrs. Ralph) and Howard B. Gelt, attorney for Anne Weiss,
adjacent property owners, we wish to make the following
responses.
I telephor:ed Mr. Gelt concerning the Ford lode mining
claim mentioned in his letter, and learned from him that his
main concern for his client was a need to know how our
operation would affect the Ford claim. After explaining what
I could over the phone, I agreed to meet at a later time and
explain to him our planned mining operation. He indicated
that neither hey nor his client knew for sure where the Ford
claim is located. We will clarify this matter for them.
In reference to paragraph 2 of the Hawes letter, the
Mining Plan (Exhibit B) states that miring is planned to
continue until 2082. After this time, when mining has ceased
will the Reclamation Plan (Exhibit E) be commenced. It is
after mining is completed that the area will be reclaimed to
to a historic tourist mine.
In reference to paragraph 3 of the Hawes letter, suggesting
incompetence among Unites States Registered Land Surveyors who
practiced from the late 1800's to early 1900's, We submit
a letter from the U.S. Department of the Interior, Bureau of
Land Management dated April 21, 1982, written by Kenneth D.
Witt, Chief of the Cadastral Survey. He states in his letter
that they are currently preparing an independent re-survey of
the Clear Creek County area and "have found no major
discrepancies in any of the surveys that we have retraced".
The permit areas has been surveyed by a civil engineer, using
in-place goverrunent markers, to determine exact boundary locations
on the ground, The work was done with a Gurley li[euntain transit
and steel chairs. The applicant does not feel it is his
responsibility to survey the Hawes' property.
,_ .
,. _.
- - - ~- -
