Grand River Park Project, M-2006-046 <br />Response to Adequacy Letter of August 1, 2006 <br />6 September 2006 <br />Page 11 <br />Any access road left in place in the post-mining condition is intended to facilitate <br />the transition to recreational use. The intensity of post-mining recreational use is <br />not known at this time, so it is intended that the improvement for access during <br />mining, namely a minimum of 8-inch road base material and a drive lane width of <br />at least 20 feet, will be maintained for future access to groundwater lakes and the <br />site generally. The access road located in the southwest corner of the site is <br />approximately 1,000 linear feet along its centerline. <br />The Division should note that certain access drives will be maintained regardless <br />of the post-mining use for mined area, as the property also hosts extractive and <br />transmission facilities for natural gas production. <br />18. The applicant indicates that a utility line will be relocated to run parallel to <br />the west boundary of the permit area. Please indicate which utility line will <br />be relocated and who is responsible for relocating it. <br />The "Relocated Utility," as labeled on the Exhibit F Reclamation Plan Map, is an <br />overhead utility line running parallel to the west boundary of the permit area, <br />This is the new alignment of the overhead power line noted on Exhibit C-1 with <br />the label "Local Electrical Service to be Relocated." The operator will be <br />responsible for coordinating with the utility company to cause the relocation of <br />the line. <br />19. In accordance with Rule 3.1.6(1J(aJ, please explain how disturbance to the <br />hydrologic balance will be minimized during the mining and reclamation <br />phase of the Grand River Park Project. Please explain how Silt Sand & <br />gravel will be in compliance with Colorado Water Laws and regulations <br />governing injury to existing water rights. Please inform the Division as to <br />when a Temporary Substitute Supply Plan (TSSP), Well Permit and Plan <br />of Augmentation will be obtained from the Division of Water Resources. <br />The Division received comments from the Office of the State Engineer <br />(OSE) regarding the application. The letter is enclosed for your reference. <br />Please acknowledge the conditions of approval noted by the OSE. <br />Rule 3.1.6(1)(a) states that disturbances to hydrologic balance, water quantity, <br />and water quality will be minimized by "compliance with applicable Colorado <br />water laws and regulations governing injury to existing water rights." As implied <br />by the discussion in Exhibit G of anticipated effects and regulatory compliance, <br />the applicant commits to complying with all applicable Colorado water laws and <br />regulations governing injury to existing water rights. <br />In this case, it is not anticipated that the proposed construction materials <br />operation will have a significant effect on the overall hydrologic balance of the <br />
