F~F:OT i~FFIiE Tit <br />~ • C <br />meeting- If the District Engineer, as a result of this review, determines that the mining <br />operation is not in compliance with the terms and conditions of this petmit, of determines the <br />mitigation efforts of the permittee are not sufficient, the permit will be suspended and the <br />permiktee will cease all mining operations unfit such time as corrective measures are taken to <br />bring the operation into compliance with the terms and conditions of the permit and mitigation <br />Pl~- <br />E. When Phase I mining begins to impact wetlands, the permittee will have one year to <br />complete construction of the temporary mitigation wetlands in the Phase III area. During Phase <br />I mining, a total of 13.b acres of wetlands will be maintained In the Phase Ii and Phase III areas <br />(9.6 acres of existing wetlands and 4.0 acres of temporary mitigation wetlands). <br />F. When Phase II mining begins, the permittee has one year to complete the construction <br />of the 7.0 acres of Phase I final mitigation wetlands. During Phase R mining, the petmittee will <br />maintain a total of 13.6 acres of wetlands (7.0 acres of final mitigation wetlands in the Phase <br />I area and 6.b acres of existing and temporary mitigation wetlands in the Phase Ili area). The <br />total amount of wetlands in the Phase Iii area may be greater than 6.6 acres, but the permittee <br />is only respcrosible for 6.6 acres at this Iocation. <br />G. When Phase III mining begins, the permittee has one year to complete the construction <br />of the 5.9 acres of Phase II final mitigation wetlands. During Phase III minting, the permittee <br />will have constructed 12.9 acres of wetlands (7.0 acres of final mitigation wetlands in the Phase <br />I area and 5.9 acres of final mitigation wetlands in the Phase II area). <br />Ii. Upon completion of Phase IIi mining, the remaining 0.7 acres of final mitigation <br />wetlands will be constructed around the shoreline of the Phase III area. This will create a total <br />of i3.6 acres of mitigaton wetlands on the project site. These wetlands must be determined to <br />be viable and self-sustaining by the Corps of Engineers. The criteria for success is the <br />dominance, of native herbaceous wetland species. <br />I. AlI mitigated wetlarxls wlll be free of landscaping, mowing, cutting, burning or any other <br />practice that might change their character. <br />
