Lessee agrees <br />that it will carry on its operations on the said premises in a good <br />and workrtwnlike manner as the same are customarily conducted in simi- <br />lar operations. Lessor shall have the right to enter upon said land <br />from time to time for the purpose o` inspection and examination, but <br />shall not unnecessarily intereieze +eith the Lessee's operations there- <br />6. Lessee agrees that it shall, at its own sole cost an3 <br />ey:pense, restore the surface of the land mined, and reclaim the top- <br />soil thereof and shall seed the same with the type of grass which <br />shall be selected by the Lessor, and Lessee shall: <br />(1) Segregate all topsoil from other <br />overburden; <br />(2) Grade the entire affected area into <br />. a gently zolling topography; <br />• (3) Replace the topsoil over the other <br />overburden. <br />7.. Lessee shall promptly pay when due all taxes which <br />may be assessed and levied against Lessee's property placed upon <br />the said premises and shall keep the said premises tree and clear <br />from all liens and encumbrances arising out of Lessee's operations <br />thereon. Lessor shall pay when due all taxes levied and assessed <br />against the surface of said pro party when due; provided, however, <br />that Lessee may make such payments for Lessor and deduct the amount <br />of same from any other payments due from Lessee to Lessor hereunder. <br />8. Lessee shall prior to the termination date hereof, <br />cause a survey to be made at its own cost and expense of the part of <br />the premises from which it has mined coal by a registered surveyor <br />• an3 the determination of the acreage therein by such survey shall <br />be binding upon the parties for purposes of Paragraph 3 of this lease. <br />9. Lessee shall promptly install at its o+vn cost and ex- <br />pense a woven wire sheep fence a reasonable distance within the <br />
