<br /> and Lessor does hereby grant, lease and demise unto Lessee
<br /> all the surface over all the coal in and on the above-described
<br />• land, together with the exclusive right to mine and remove
<br /> said coal, by the strip mining method or any other method,
<br /> such of said coal as is, in the opinion of Lessee, merchantable,
<br /> commercially available and economically recoverable, without
<br /> claim or liability for damage to said land, except as herein-
<br /> after provided, together with the other rights hereinafter set
<br /> forth; to have and to hold the same unto Lessee, its successors
<br /> and assigns, foz and during the term and period of five (5)
<br /> years from date hereof, upon the following terms and conditions:
<br /> 1. Lessee shall have the right of free ingress and egress
<br /> to, from and across said land at any time during the term of
<br /> this lease, or any extension thereof, with such persons, tools,
<br /> machinery and appliances as may be necessary or useful for the
<br /> purpose of exploring, testing, mining, reclaiming, and transport-
<br /> ing coal from, the above-described lands or from other lands in
<br /> the general vicinity thezeof which Lessee is or will be mining
<br />• as part of a mining unit or mining plan.
