We have no recorded <br />agreement between the operator and the National Park Service for right to <br />enter for the purpose of mining gravel. Apparently, Colorado State law <br />requires documented legal access right between the surface owner and holder <br />of mineral rights. If Mt. Formaz was to make such a request, we would <br />initiate this process under a Special Use Permit for the operation. The <br />permit would include specific stipulations of concern to the National Park <br />Service and include the recommendations made by the Mined Land Reclamation <br />Board at the hearing.
