A close reading of the permit has revealed two possible
errors, one minor and one major.
The minor error is in the first line after SdI'fNESSETIi on the first
page where it states that our company "...desires to conduct an "open"
mining operation...". The Henderson Mine is an underground mining operation.
The major error is special condition number 1 on page 2 of the permit.
The condition states "...shall not allow the total disturbed acreage to
exceed 940 acres of affected land." The Timetable of Disturbance and
Reclamation, Table 5.1, pages 5 - 11 of the application, indicates 940 acres
of "affected land" in 1977, approximately 876 acres in 1979, 1,077 acres
by 1983, etc. Obviously, more than 940 acres will be disturbed during the
course of the operation. 'file "total surface acreage to be ~nc].uded in
the permit", item 13 on the application form, indicates the "permitted area"
to be 6,627.6 acres. Another point that should be noted is that tae fully
intend to update the bond as necessary, as affected land increases due mainly
to the ongoing deposition of tailing.
We would appreciate it if yo,i or the appropriate member of your staff
would look into this matter and make the appropriate changes in the permit.
Sincerely,
LFB:ms
Y ;~ ~• 1 ~~+ow-~
Larry W.
