Dept. of Natural Resources <br />We are in receipt of the aforementioned permit with a cover letter <br />from Mark Heffner. A close reading of the permit has revealed two possible <br />errors, one minor and one major. <br />The minor error is in the first line after WITNESSETH on the first <br />page where it states that our company "...desires to conduct an "open" <br />mining operation...". The Henderson Mine is an underground mining operation. <br />The major error is special condition number 1 on page 2 of the permit. <br />The condition states "...shall not allow the total disturbed acreage to <br />exceed 940 acres of affected land." The Timetable of Disturbance and <br />Reclamation, Table 5.1, pages 5 - 11 of the application, indicates 940 acres <br />of "affected land" in 1977, approximately 876 acres in 1979, 1,077 acres <br />by 1983, etc. Obviously, more than 940 acres will be disturbed during the <br />course of the operation. The "total surface acreage to be included in <br />the permit", item 13 on the application form, indicates the "permitted area" <br />to be 6,627.6 acres. Another point that should be noted is that we fully <br />intend to update the bond as necessary as affected land increases due mainly <br />to the ongoing deposition of tailing. <br />We would appreciate it if you or the appropriate member of your staff <br />would look into this matter and make the appropriate changes in the permit. <br />LFB:ms <br />xc: J.
