Cattany <br />V <br />RE: Schumacher Pit #3, Application No. M-2006-072 Division Director <br />Natural Resource Trustee <br />~dequacy Review <br />Deaz Mr. Schumacher, <br />Listed below are adequacy review comments on the Schumacher Pit #3 New 112 Application, <br />Permit Number M-2006-072. The Division of Reclamation, Mining and Safety (Division) is <br />required to make an approval or denial decision no later than January 2, 2007, therefore, your <br />response to the following adequacy review concerns should be submitted to the Division as soon <br />as possible. <br />1. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice <br />circulated in the local newspaper, all owners of record of surface lands and mineral rights, <br />easement holders, and owners of record of surface lands that are within 200 feet of the <br />boundary of the affected land. Proof of notice maybe return receipts of a Certified Mailing <br />or by proof of personal service. <br />2. The Division received comments from the Office of the State Engineer, the Colorado <br />Historical Society and the Department of the Army. The letters are attached for your review. <br />Rule 6.4.3 Exhibit C- Pre-Mining_and Minina Plan Maps <br />3. IxL accordance with Rule 6.4.3(c) please provide the pre-mining contour elevations at the site <br />and revise Exhibit C-1 accordingly. <br />4. Rule 6.4.3(f) requires that all water wells in the surrounding area be identified on the map. <br />The Division could not locate any water wells on the exhibits. Please locate the wells on a <br />map and state the owners and the depth of the wells. <br />5. Per Rule 6.4.3(g), the applicant will need to depict the owner's name, type of structure and <br />location of all significant, valuable and permanent man-made structures on the azea of <br />affected land and within 200 feet of the affected land. Please identify the owners of all roads, <br />ditches, pipelines, gas lines, gas wells, utility lines, water wells, fences, buildings, ponds, <br />etc... on and within 200 feet of the affected land. <br />6. There appears to be several creeks and or ditches within the permit azea.
