05045 Banks and Gesso, LLC <br />Exhibit M -Other Permits and Licenses <br />Additional permits and approvals required for the Jemadojin Sand Mine are listed below. <br />EI Paso County Special Use Permit <br />The applicant is applying for an EI Paso County Special Use Permit to obtain land use <br />approval for mining and related activities at this site. <br />CDPS Stormwater Discharge Permit <br />Any stormwater the comes in contact with affected areas will be contained on-site and is <br />expected to immediately seep or evaporate. Therefore a discharge permit is not <br />required. <br />Air Permits <br />The applicant will submit an Air Pollution Emission Notice (APEN) for Fugitive Dust and <br />a General APEN to the Colorado Department of Public Health and Environment's Air <br />Pollution Control Division prior to commencing site disturbance and processing activities. <br />County Road Access permit <br />The applicant will obtain a county road access permit (if required) prior to commencing <br />operations. <br />Substitute Water Supply Plan/Well Permits <br />This operation will not use or encounter groundwater, therefore a gravel pit well permit or <br />Substitute Water Supply Plan is not necessary. <br />State Historic Preservation Office <br />Please see the results of a search of the Colorado Inventory of Cultural Resources in <br />Attachment B. There are no historic structures located within the permit boundary. A <br />survey was found in the same section as the site but is located outside of the permit <br />boundary. <br />Spill Prevention Control and Countermeasure (SPCC) Plan <br />The applicant may have a contained diesel fuel tank located on site of 1,000 gallons or <br />less so a SPCC Plan will not be required. <br />Oglebay Norton Industrial Sands, Inc.
