~. On page 2 of the application form [he applicant is required to list any designated chemicals or acid- <br />producing materials to be used or stored within the permit area. The applicant has responded with "None <br />are proposed a[ the present time and none are anticipated." The Division has received an objection letter <br />from Loretta Van Nors'trand dated April 4, 2001 indicating a concern of water quality impacts to private <br />well owners in the town of Milner due to diesel fuel and oil use on site. Please verify whether their will be <br />use and/or storage of any chemicals or petroleum products on site such as calcium chloride, diesel fuel, <br />gasoline, oil & grease, degreasers, lubricants, hydraulic fluid, waste oil, antifreeze, calcium chloride, etc. <br />(Operation of heavy equipment as indicated in the mine plan typically implies use of several or more of the <br />chemicals/products listed above). <br />Sa. If any such chemicals/products will be used on site, the Division requests that the applicant identify [he <br />chemicaVproduct to be used; list the typical volume to be used; and submit a spill prevention, control, and <br />countermeasure plan to ensure protection of groundwter quality within the affected land and surtounding <br />area in the event of a leak or spill from any such chemicaVproduct. Please address. <br />Sb. If any such chemicals/products will be stored on site, the Division requests that [he applicant define <br />where and how they will be stored. The mine plan map should be revised to show the location of any <br />storage areas. The narrative of the mine plan should also be revised to describe how such <br />chemicals/products will be stored. I[ is preferred that any chemicals/products be stored outside of the 100- <br />year floodplains of Trout Creek and the Yampa River. Any protective berms or containment [o be used <br />should be adequate to contain 100% of the volume of stored chemicaVproduct. If storage outside of the <br />floodplains is not feasible, then [he applicant will need to address specific measures to be employed that <br />will ensure adequate containment during a flooding event. Plan views or cross-sectional designs of any <br />containment sytems will be helpful. Please address. <br />6. The applicant states on page 12 that clean, inert fill material will be accepted from outside contractors <br />which can be hauled to this site to ensure that the shoreline is graded in a natural looking configuration. <br />Please note that prior to any use of inert fill being brought in from off-site, the applicant will need to <br />provide a notice which meets [he minimum requirements of Rule 3.1.5(9). Attached is a copy of Rule <br />3.1.5(9) for your use. Please respond. <br />7. Regarding [he maximum disturbance expected, the applicant states on page 5 the area to be affected by <br />the gravel mining activities in the proposed mine pit area is 41.76 acres; on page 7 the maximum area <br />which will be actively mined a[ any one time, excluding reclamation will be six (6) acres; and on page 23 a <br />maximum disturbance at any one time of 25 acres. In conformance with Rule 6.4.4(d), please clarify the <br />maximum disturbance to be expected at any time throughout the life of the operation. Such maximum <br />disturbance should include areas (acreages) and volumes of pit disturbances assuming near vertical walls, <br />volume of overburden [o be generated and stockpiled, volume of topsoil to be salvaged and stockpiled, <br />lengths of pit wall [ha[ have been backfilled and graded to finish contours, lengths of backfilled & graded <br />pit walls and/or acreages of affected land that have been topsoiled and require revegetation, and the plan[ <br />site area. (Please be sure to include the sedimentation pond, and any excess overburden generated during <br />the I st 6 years of the operation as indicated on page 8). Such maximum disturbance is needed to calculate <br />an appropriate and accurate reclamation cost. As an alternative, the applicant may indicate the entire <br />affected land acreage will be disturbed and provide a reclamation cost estimate adequate to reclaim such <br />disturbance. <br />8. The applicant states on page 7 that all proposed water diversions and sedimentation ponds are shown on <br />Map 3. The applicant also states on page 9 that dewatering operations are necessary to expose and <br />excavate the gravel deposit on this site.
