• which to commence and theratter diligently complete the curing of such default) before Lessor may terminate thi's agreement by ninety (90) days notice to that effect, but if such default or defaults be cured, there shall be no breach hereunder with respect to the same. If Lessor terminates this agreement on account of breach by Lessee, Lessee shall be under no further obligation or liability hereunder to Lessor from and after the date of such termination except for the obligation hereunder relative to accrued Annual Minimum Royalty payments, payment of its share of accrued taxes as specified in Section 10.2, performance of any reclamation requirom~nts az specified in 6ection 6.2, and the liabilities to Lessor, if any, for Production $oyalty which has accrued to the date of such termination. Except as aforesaid Lessee shall not be liable to Lessor for any general or special damages for any breach hereunder, whether Lessor exercises . its rights of termination or otherwise. • 12.3 Termination by Lessee. Lessee shall have the right to terminate this Lease at any time upon written notice delivered to Lessor and the payment oP the unpaid balance, if any, of accrued Annual Minimum Royalties. The termination shall take effect upon any future date set forth in the notice, or, if no date is specified, upon the date of delivery of the notice. Upon such termination, all right, title and interest of Lessee under this Lease shall terminate, and Lessee shall not be required to make any further payments, or to perform any further obligations hereunder, except payments or obligations which then have accrued under the express provisions of this Leases and which have not been paid or performed. ARTICLE XIII ARBITRATION 13.1 In case of any dispute or difference between the • parties the same shall be submitted to and determined and settled by arbitration which shall be conducted by and under the rules of the American Arbitration Association, except as 13
