• at Lessor's option, shall be removed by Lessor or its agents <br />or employees „ at Lessee's expense. <br />ARTICLE X <br />TA_xFS: ASSIGNMENT <br />10.1 So long as the within Lease shall remain in force <br />and effectt, Lessee shall pay when due all taxes assessed <br />against its personal property and improvements placed upon <br />the Leased Premises and all taxes, if any, levied against the <br />Leased Premises, or any part thereof, as a non-producing <br />property, except that Lessor shall be responsible for paying <br />any taxes levied on Annual Minimum Royalty payments or <br />Production Royalty Payments which it receives. Lessor shall <br />be responsible for the payment of that portion of anyother <br />taxes levied and assessed against the Leased Premises during <br />the term of this Lease which are based upon or measured by ' <br />producttion of coal by Lessee from the Leased Premises, in <br />• proportion as the amount of royalty received by Lessor <br />hereunder bears to the total amount received by Lessee for <br />such production; the balance of all such taxes shall be paid <br />by Lessee. Any servance taxes pertaining to production from <br />the said Leased Premises realized by Lessee under the <br />provisions of this Lease, shall be divided in the same manner <br />as taxes levied upon the Leased Premises based upon or <br />measured by production as set forth above. Lessee shall have <br />the privilege of paying the entire amount of any taxes levied <br />upon the Leased Premises or production therefrom, as above <br />specified, and recouping the amount thereof which should have <br />been paid by Lessor pursuant hereto from any royalties which <br />may become due and payable under the terms of this Lease. <br />Lessee shall properly and timely Prepare, execute and file on <br />behalf of itself and Lessor all reports, returns, affidavits <br />and other documents required pursuant to applicable <br />governmental taxing authorities establish the value for <br />• property tax purposes of the Leased Premises (except reports <br />relating to separate valuation of the surface of the leased <br />premises).• <br />10 <br />
