-2- <br />location 005 is Pond 5 which controls runoff from the Pit 5/6 area. This pond <br />recently underwent reconstruction to comply with Rule 4.05.9 Permanent <br />Impoundments) for use as a livestock source. It is located along Grassy <br />Creek, and due to natural spring flow, and surface runoff from the above <br />contributing watershed it may discharge on a perennial basis. Again, as <br />required by Rule 4.05.9(1>(a), CDMG has found that the effluent from this pond <br />will meet State and Federal water quality standards. Pond 5 Is also designed <br />and certified to control settleable solids within appropriate limas. <br />Final bond release/forfeiture has occurred. Rockcastle Coal Company has <br />complied wtth all parts of the Settlement Agreement dated 6/2bi90, between <br />Rockcastle Coal Company,' and CDMG. Based upon this final bond release <br />forfeiture, and the site conditions, as verified by Jim Chubrilo of WQCD, and <br />COMG, it is our opinion that the. site has been satl5factorily reclaimed.
