Rindahl -2- November 4, 1983 <br />Exhibit A <br />An examination of the map exhibits and the legal description indicates <br />that the metes and bounds description given is for the property owned by <br />the operator, but not for the proposed permit area, since the proposed <br />permit boundary lies within the ownership boundary on all sides except <br />where the haul road joins Vollmer Road. This observation generates the <br />following questions and comments: <br />What is to be the acreage of the permit area? <br />2. The description of the permit area should be in metes and bounds or <br />to the nearest quarter quarter sections. Please provide an appropriate <br />legal description for the acreage actually to be permitted. <br />3. Since the permit area is immediately adjacent to Vollmer Road <br />(presumably an El Paso County road), the County should be considered an <br />adjacent landowner and notified as such. <br />Exhibit C <br />Jl. Please explain the interaction of the mining operation and the <br />existing ponds shown on the map. Will they provide any water to the <br />mining operation? Given their close proximity to processing areas, how <br />will they be protected from sediment? <br />2. Where is the screening and product stockpile area on the mining <br />J plan map? <br />3. I notice the existence of a drainage way running along the eastern <br />boundary of the permit area. Please give more details concerning this <br />drainage. What is the nature of the drainage way (e.g., ephemeral), and <br />how will it be protected from effects of the mining and processing <br />activities adjacent to it? <br />4. Given the fact that this permit will not issue until some time in <br />the latter half of December of this year (at the earliest), the sequence <br />of mining phases shown on the map (marked 1983, 1984, 1985, and 1986) <br />should probably be advanced one year (as should the life of the mining <br />operation). Please clarify this matter. <br />Exhibit D <br />.~ 1. Where is the topsoil already stripped from 20 acres of the 35 acre <br />,a~°~u^' z'~permit area? Topsoil stockpiles are not shown as previously existing on <br />.~ the pre-mining map. At a 6" depth, this topsoil should amount to 16,133 <br />M" cubic yards of topsoil. Is this topsoil already stockpiled in the <br />topsoil storage area? If so, does it come from the plant site, roads, <br />and the first 4.3 acre phase to be mined? Please clarify this entire <br />matter. <br />
