Removal and stock piling of all organic <br />material and topsoil prior to water impounding has been completed. <br />To the beet of my knowledge, based upon my professional expertise, <br />all Sediment Control Ponds at the Deserado Mine has been <br />constructed in conformance with the prudent state-of-the-art of dam <br />construction. Further, the structures have been constructed in <br />compliance with the approved design of the approved permit <br />document. <br />Z certify, based upon the field observation and professional <br />investigation, as detailed here above, that all Sediment Control <br />Pond Structures located at Western Fuels-Utah, Inc, Deserado Mine, <br />in Rio Blanco County, Colorado, has been constructed in compliance <br />with the design approved as a portion of Permit No. C-018-81, <br />issued by the Division of Minerals and Geology. <br />Respe~~`r'1 <br />~G(~G/ <br />Michael J.
