PART I <br />Page xiii <br />Permit No. CO-0043648 <br />b. Discharges From the Valley Leach Facility That Qualify for Annual Precipitation or Storm Exemptions -Point <br />007A <br />For any discharge from the Valley Leach Facility that may qualify for the amual precipitation or storm <br />exemptions described in Part I.A.1.6. and c., the permit[ee shall initiate sampling and analysis of that discharge <br />as soon as it is discovered. The parameters to be analyzed for are those listed in Table I.B.-1. Monitoring of <br />such discharges shall continue at the frequency shown in Table I.B.-1 until the discharge is eliminated. <br />c. Groundwater Monitoring <br />The permittee has developed a groundwater monitoring program in order to satisfy requirements specified by the <br />State Division of Minerals end Geology. It may be necessary or advantageous for at least some the <br />groundwater data collected to be used in the development of analyses that can demonstrate the permittee's <br />compliance with the "no discharge" provisions of this CDPS permit. <br />4. Chronic Whole EfFluen[ Toxicity Testing - Outfall 007A <br />(a) Testing and Renortine Requirements <br />Tests shall be done at the frequency listed in Part I.B.1. Test results shall be reported along with the <br />Discharge Monitoring Report (DMR) submitted for the reporting period during which the sample was taken. <br />(i.e., WET testing results for the first calendar quarter ending March 31 shall be reported with [he DMR due <br />April 28.) The results shall be submitted on the Chronic Toxicity Test report form, available from the <br />Division. Copies of these reports are to be submitted to both the Division and EPA along with the DMR. <br />The pertnit[ee shall conduct each chronic WET test in general accordance with methods described Short Term <br />Methods for Estimatin the Chronic Tozicitv of Effluents and Receiving Waters [o Freshwater Organisms, <br />EPA/600/4-89/001 or the most current edition, except as modified by the most current Division guidance <br />document entitled Guidelines for Conducting Whole Effluent Toxicity Tests. The permittee shall conduct such <br />tests using Ceriodaphnia dubia and fathead minnows. <br />(b) Failure of Test and Division Notification fBeginnine gn Effective Date of Limitation) <br />Beginning on the effective date of the limitation, a chronic WET test is failed whenever there is a statistically <br />significant difference in lethality between the control and any effluent concentration less than or equal to the <br />instream waste concentration ('IWC"). The IWC for this permit has been determined to be 100%. The <br />permittee must provide written notification of the failure of a WET test to the Division, along with a statement <br />as to whether a Preliminary Toxicity Investigation ("PTI")/Toxicity Identification Evaluation ("TIE") or <br />accelerated testing is being performed. Notification must be received by [he Division within 2] calendar <br />days of the demoristra[ion of chronic \VET in the routine required lest. "Demonstration" for the purposes <br />of Parts I. B.4(b),(c),(d), (e) and (g) means no later than the last day of the laboratory test. <br />(c) Automatic Compliance Schedule Upon Failure of Test <br />If a routine chronic WET test is failed, the following automatic compliance schedule shall apply. As part of this <br />the perrmttee shall either: . <br />(i) proceed to conduct the PTI/TIE investigation as described in Par I.B.4.e, or <br />(ii) conduct accelerated testing using the single species found to be more sensitive. <br />INUHP aN~41 <br />
