Erickson <br /> RE: Western Slope Flagstone Quarry No. 2 <br /> Permit No. M-96-076 <br /> The Mining Plan for construction of the sediment embankment will be according to the DMG <br /> recommendations as follows: <br /> Remove vegetation and topsoil from the area underlying the embankment. <br /> Appropriate compaction of underlying soil and excavation of a key trench to provide <br /> foundation for embankment. <br /> Appropriate compaction of embankment material during construction. <br /> Establish a vegetative cover to stabilize the embankment outslopes. <br /> Construction of an erosion resistant (Rip/Rap lined) spillway structure. <br /> Exhibit D - Reclamation Plan - The sediment containment ditch will be re-graded during the final <br /> reclamation process. The sediment containment pond will remain as a permanent structure to <br /> provide stock water. <br /> Thank you for the information and copy of notice required by Office of the State Engineer. <br /> Exhibit L- Permanent Man Made Structures - The Indemnification Agreement with Public <br /> Service Company just arrived and will be sent under separate cover by Rudy Fontanari. <br /> The revised Indemnification Agreement for Powderhorn Coal is enclosed. <br /> Powder Mountain Ranch has used Mr. Fontanari since 1991 as agent to operate and maintain <br /> the Martin Crawford Ditch in their behalf. See enclosed letter and note from Robert Orr. <br /> Ute Water Conservancy District has no water lines within 200 feet of the permit boundary. Three <br /> (3) Haul Road crossings of Ute Water's underground pipeline to the filtration plant are identified <br /> on the enclosed exhibit. <br /> Financial Warranty - Western Slope Flagstone agrees with the calculation for financial warranty <br /> in the amount of$3,078.00. <br /> To the best of my knowledge, all of the items which you outlined in your letters, have been <br /> provided.
