Please send us two current copies of"Construction Material Rules and Regulations of <br /> the Colorado Mined Land Reclamation Board", effective 1/96. <br /> Enclosed is our check No. 5606 for$16.00. <br /> ADEQUACY ISSUES <br /> Public Notice - Enclosed are two notarized "Proof of Publications"; one for September 13, 1996 <br /> and another for December 17, 1996. <br /> These notices were hand delivered to Mr. Robert Orr, managing partner for Powder Mountain <br /> Ranch. Powder Mountain Ranch is the only owner of surface rights within 200 feet of the <br /> boundary of the affected lands. Powder Mountain Ranch also owns the Martin Crawford Ditch <br /> identified under Exhibit L. Mr. Robert Orr confirmed by his written note that Powder Mountain <br /> Ranch has "no problem with this and the Martin Crawford Ditch" verified by his signature dated <br /> January 30, 1997. <br /> Exhibit C - Mining Plan - No improvements were planned or are necessary to the pre-existing <br /> haul road, for it has previously been supporting the removal of construction materials by SEM <br /> Construction since 1986. However, due to the concern by Ute Water that "heavily loaded truck <br /> traffic" may require additional protection of it's water mains, additional road base, as discussed <br /> with Ute Water, will be placed at the three (3) water main crossings identified on the enclosed <br /> exhibit for Haul Road Crossings of Ute Water Pipeline. <br />
