Portions of the mining and reclamation limits noted on the maps do not coincide with one <br />another. For example, the reclamation plan map depicts disturbance within 20 feet of the <br />Arkansas River, but at the same location mining is within 100 feet of the river. Please clarify <br />these discrepancies. <br />Rule 6.3.12 Exhibit L-Permanent Man-Made Structures <br />25. Please be aware if the applicant encroaches into any easements as a result of the mining and <br />operation plan, then the applicant must obtain legal right of entry document from the easement <br />holder (i.e. roads and ditches). Please state what easements will be included, and provide legal <br />right of entry agreements. <br />26. Rule 6.3.12(a) requires the applicant to provide a notarized agreement between the Applicant <br />(ACA Products) and the Person(s) having an interest in the structure, that the Applicant is to <br />provide compensation for any damage to the structure. Because the Bray-Allen Ditch will be <br />mined through and relocated through a pipe as a result of the mining operation, the applicant <br />will need to submit notarized agreements between the applicant and all owners/easement <br />holders of ditch that is to be removed and relocated. Please provide the notarized agreements. <br />27. For the portion of the Bray-Allen Ditch that is currently buried, please explain how mining <br />will impact the pipeline. <br />Please be advised that River Pazk Recreation Access New 110 Application may be deemed <br />inadequate, and the application maybe denied on August 11, 2005 unless the above-mentioned <br />adequacy review items aze addressed to the satisfaction of the Division. If you feel more time is <br />needed to complete your reply, the Division can grant an extension to the decision date. This <br />will be done upon receipt of a written waiver of your right to a decision by August 11, 2005 and <br />request for additional time.
