Pitkin County recognizes that the State of Colorado's Mined Land <br />Reclamation Board will require a bond for revegetation. So as not <br />,to duplicate said bonding Pitkin County will not require a bond <br />r <br />' at this time. However, Pitkin County shall review the bonding <br />and reclamation provisions and progress thereunder at each of its <br />annual hearings. Should reclamation o-+ork or the bonding provisions <br />prove to be unsatisfactory, the County may require a bond of an <br />amount per acre of land to be disturbed which is reasonable to cover <br />the costs of reclamation. This permit shall be null and void if <br />the bond is not furnished and the permittee shall cease all work <br />hereunder. <br />13. As additional consideration for the permit herein granted: <br />A. The Operator agrees to make its facilities available for public <br />1, <br />road construction projects as a designated pit site which includes <br />the rights to quarry gravel, conduct production operations, and <br />ingress and egress the site; prcvided that: <br />(1) A royalty at the then prevailing market rate be paid for <br />extracted gravel; <br />" (2) This activity does not significantly interfere with normal <br />operations; ~ ' <br />(3) This right applies only to invitation to bids for public <br />' works projects in excess of $100,000 gross; <br />(4)" A suitable bond be posted with the operator for each . <br />'project to ensure cleanup and revegetation. <br />" (5) An amendment to this special review permit is required by <br />the public entity proposing to use the designated pit site <br />which amendment shall specify the extent and nature of <br />", extractive operations to occur on the site and any mitigation <br />procedures necessary. " <br />B. The Operator agrees to participate with Pitkin County in the cast <br />and construction of improvements pursuant to the County Engineer's <br />reconmiendation (reference is made to the public hearing file) <br />to County Road 17, the River Road.
