Box 449 <br />Florence, Colorado 81226 <br />Dear Chuck <br />I am writing this letter to confirm our agreement regarding improvements <br />you intend to make on Adamic land in association with the expansion work at <br />your coal loading facility. By this agreement, you may have the right to <br />enter and do the following work as described below, and discussed on <br />August 4, 1982. <br />(1) Additional 50 feet parallel to the lease line described in <br />Tract 2 as N 62 45 ft. 54 inches E to establish a two (2) <br />foot to one (1) foot slope after the gravel material has been <br />excavated to the lease line. <br />• (2) Additional 100 feet parallel to 435 feet side of Tract 3 <br />to allow for sloping and movement of the dirt pile excavated <br />from the C.F. ~ 1 ditch. <br />(3) To place any excess material in the old railroad bed adjacent <br />to the Dorchester Coal Lease. <br />(4) Dorchester Coal shall be responsible for all reclaimation and <br />reseeding of these described areas. <br />(5) Dorchester Coal may install "Permit Boundry" markers around the <br />described areas where reclaimation and reseeding must be done. <br />(6) Dorchester Coal shall replace all fence lines promptly following <br />completion of material excavations.
