<br />when the Following proceedings, among others, were had end done, to-wit:

<br />WHEREAS, application was made to the Board of County Connnissioners by Nick
<br />Peck for a Special Use Permit to operate a sand and gravel operation on certain real
<br />property located in Ouray County, Colorado, described as the SE}SW} Section 2 and
<br />NE}N!J} Section 11, Township 44 North, Range 8 West, N.M.P.M.;
<br />WIIEREAS, the subject application Iras been found to be in proper fora}r and
<br />all notices of public hearings have been duly issued;
<br />WIIEREAS, a public hearing was held before the Board of County Commi$sioner
<br />August 7, 1990, which bearing was continued until October 15, 1990;
<br />WIIEREAS, the Board referred this matter to the Ouray County Plannin
<br />Commission which held a special meeting at which public comment was received n this
<br />matter on August 28, 1990. The Board has received the resolution of the Plan ing
<br />Conrrnission which recommends denial of the subject. At these hearings, a very sub-
<br />stantial record has been made including both testimony and documentary eviden e,
<br />which has been duly considered by the Board;
<br />IJHEREAS, the Board hereby finds that the neighborhood in which the p opose
<br />use is to be located includes a mixture of uses including a sand and gravel op ratio
<br />light industrial operation, agricultural uses, residential uses, and others;
<br />WIIEREAS, the record contains much technical information about the im act
<br />of the proposed use on adjoining property owners and the Board recognizes that there
<br />are many competing interests in this matter. The Board hereby finds that the
<br />evirJence in the records supports a decision either of approval with conditions or
<br />denial of the application; and
<br />WIIEREAS, the Board is desirous of approving the application with con ition
<br />wlriclr approval is based upon tare Ouray County Land Use Cade and tire record nrad in
<br />the above public hearings. Tfre Board finds that the proposed use is compatibl with
<br />existing uses in the neighborhood and tare requirements of tare Ouray County Lan Use
<br />Code provided that the following conditions are imposed and complied with by t e
<br />applicant.
