<br /> <br />SAND AND GRAVEL LEASE <br />This Lease is entered into this ~ day of August, 2000, <br />between WOODROW W. HEIST and PHOEBE B. HEIST, 520 Taylor Street, <br />Sterling, Colorado 80751, referred to herein as "Lessors", and <br />BRIAN BARYON and TODD DYSART, doing business as Barton & Dysart, <br />1957 County Road 57, Sterling, Colorado 80751, referred to herein <br />as "Lessees". <br />1. Lessors, in consideration of the agreements set forth in this Lease, to be <br />kept and performed by Lessees, and of the payment by Lessees as provided in this <br />Lease, and subject to the terms, conditions and provisions contained in this Lease, <br />Lease to Lessees a tract of land described as the SW'y/SE'-,~ and the W 120' of SE's/SE'-a <br />of Section 8, Township 6 North, Fange 51 West of the 6th P.M., Logan County, <br />Colorado, for the purpose of removing and marketing sand and gravel from the <br />leased.presises. <br />2. This Lease shall be in effect for a period of five (5) <br />years from September 1, 2000 to August 31, 2005. <br />3. Lessees have the right and option to renew this Lease for <br />successive periods of one (1) year, for a total of five additional <br />years. <br />4. If Lessees desire to exercise this option to renew this <br />Lease for successive periods, it shall, at the beginning of each <br />additional lease period, pay Lessors the first month's rent, which <br />shall hind both parties for the successive period. <br />5. Lessees shall pay to Lessors $100.00 per month rental fee <br />for the premises, which will be due the first day of each month <br />beginning September 1, 2000, together with, as royalty, $.25 for <br />each cubic yard of materials removed from the premises. The <br />quantity shall determine after the materials are loaded in trucks. <br />Lessees shall pay the amount of royalty due Lessors at the end of <br />the following month for materials removed during the previous <br />month. Lessees shall provide Lessors with monthly reports showing <br />the quantity of materials removed during the previous month. <br />6. During certain months of the year, it may be impractical <br />to remove materials because of weather conditions. No report shall <br />be required for any month during which no materials have been <br />removed. <br />7. In digging pits for the purpose of producing and removing <br />materials, Lessees shall make separate stock piles of top soil and <br />of waste substances. Upon completion of the removal of materials <br />from pits that have been dug on the leased premises, Lessees w.11 <br />place any unused waste substances and materials used for roadways <br />back into the pits from which the substances and materials were <br />removed, and place top soil on top. Lessee will back-slope the <br />pits using the substances and materials as had been removed from <br />EXHIBIT G-1, PAGE 1 OF 2 <br />
