(ALSO KNOWN AS THE OPHQt-NEVADA MINING <br />COMPANY) TO CONDUCT A MINING OPERATION WITHIN HIIVSDALE COUNTY <br />UNDER THE STATE OF COLORADO'S LIMITER A7PACT (i 10) PERMIP PROCESS <br />WHEREAS, the Boats ofCoumy Commissioners are authorized under Article 28, Title 30 of the <br />Colorado Revised Statutes to apply zoning regulations to all or part of the County; and <br />WHEREAS, the Board of County Commissioners have previously adopted a Resolution <br />Establishing Zoning Districts for Ilinsdak County, Colorado; and <br />R'HEREAS, it is in the best interests ofthe County to allow certain exceptions to the zoning <br />regulations upoe proper application for a specal use perolit to the Board of County <br />Commissioners; and <br />WHEREAS, section 5 of the Cotuuy 7.oning Regtilatiors allows for and prescribes the <br />appropriate procedures to apply for a spacal use permit; and <br />WHEREAS, the l~fidas Muurrg Company, ]nc., has propeAly applied to the various State of <br />Colorado and federal agencies and has received the necessary permits; and <br />WHEREAS, the Midas Mining Company, Inc, has also properly applied to the Board of County <br />Commissioners and met the necessary requirements of the county zoning resolution; and <br />WHEREAS, after proper advertisement, a pubGe bearing concerning the proposed spacial use <br />permit was held by the County Commissioners at their February 5 and March 5, 2003 meetings; <br />and <br />W)~:REAS, a@er consideration of public comments to such proposal, and determination that the <br />qucstiorls sad requirements listed in Suction 6 of the comfy zotring resolution can be properly and <br />reasonably mitigated, the Board of County Commissioners finds the[ the proposed use is in the <br />overall best interest sad welfare of the citizens of the coumy. <br />
