<br />survive the termination of this Lease and specifically include reclamation necessitated by all mining <br />or exploration activities conducted on the Leased Premises prior to the granting of this Lease. <br />Section 16. BOND <br />Lessee agrees to famish a payment and performance bond, in a form acceptable to UPLRC, <br />in an amount of not less than Ten Thousand Dollazs ($10,000.00), approved by a corporate surety <br />company authorized to transact business in the state in which the Leased Premises are situated, and <br />otherwise acceptable to UPLRC, to insure the accuracy of the amounts Lessee represents to have <br />been removed from Leased Premises during any year of this Lease. Such bond will also take into <br />account the value of the Leased Premises and the amount of potential damage to the Leased Premises <br />and will be conditioned upon the payment of all monies and royalties accruing to UPLRC under the <br />terms hereof, and upon Lessee's full compliance with all other terms and conditions of this Lease. <br />Such bond shall be furnished to UPLRC prior to the excavation of the Leased Premises and may be <br />increased in such reasonable amounts as UPLRC may deem necessary as the excavation and <br />removal of the material outlined to be excavated and removed progress. <br />It is expressly agreed that the amount of the aforesaid bond is not intended to be a limitation <br />of Lessee's liability under the terms of this Lease. <br />ection 17. INSURANCE <br />Lessee shall procure and keep in effect, during the life of this Lease, insurance as described <br />in subsections (a), (b) and (c) of this section. The policy or policies procured by Lessee shall <br />provide for a thirty (30) day notice of cancellation to UPLRC and shall be in a form and with <br />carriers acceptable to UPLRC and shall provide minimum limits as follows: <br />(a) Workmen's Compensation Insurance with statutory limits of liability and <br />Employer's Liability Insurance with limits not less than $1,000,000. <br />(b) Comprehensive General Liability Insurance, including premises liability and <br />contractual liability but excluding pollution and contamination liability, with a combined <br />single limit of not less than $1,000,000 each occurrence bodily injury and property damage. <br />(c) Comprehensive Automobile Liability including all owned, non-owned, leased <br />or hired vehicles with a combined single limit of not less than $1,000,000 per occurrence <br />bodily injury and property damage. <br />As to the above described insurance in paragraphs (b) and (c), Lessee shall add UPLRC to <br />the insurance policies as additional insured in accordance with the following additional insured <br />endorsement: <br />"In consideration of the premium charged, Union Pacific Land Resources Corporation is <br />Page 7 of 13 <br />
