The removed sediment will be hauled to the <br />Kerr mine area and disposed of by burying it to a depth of greater than <br />50 feet to the pits. <br />The pond will be examined for structural weakness, erosion and other <br />hazardous conditions on a quarterly basis and reports will be submitted <br />to the regulatory authority. <br />Unless otherwise needed or required by State or Federal law. the <br />sedimentation pond will be completely removed and reclaimed after the <br />termination of operations. but not until the disturbed area has been <br />restored and revegetation requirements are met. <br />DISCHARGE STRUCTURES <br />Kerr Coal has designed both discharge channels (emergency spillway <br />• channel and primary spillway channel) to safely pass the flow from the <br />appropriate design events. As stated previously, the discharge channels <br />have been lined with riprap. Thus, the need for additional energy <br />dissipators, surge ponds, or other devices to reduce erosion 1s not <br />anticipated; however, the existing channels will be inspected regularly <br />during periods of flow and if deemed necessary, erosion control <br />structures will be installed. <br />• <br />23-169 <br />
