.. ~ • • <br />ISSUES RAISF_D DURING THE INITIAL PURL/C COMMENT PERIOD <br />Mr. Swift concerns were raised during the initial public comment period. <br />Response: <br />The Division has reviewed the initial application and the applicant's response to the <br />Division adequacy review. The Division believes that with the implementation of the mining <br />and reclamation plan as revised by the applicant in response to the adequacy review (August <br />26, 1999 correspondence Tuttle Applegate, Inc. to Gregg Squire, RE: Connell Resource, <br />Inc.; Timnath Connell Pit Application; M-99-050; Adequacy Response) resolves the <br />problems <br />[n addition to the revised mining and reclamation plan the Division will require that four <br />stipulations be met. These stipulations aze as follows: <br />The Applicant must keep excavations at least two feet above the maximum <br />groundwater elevation until a Substitute Water Supply Plan is approved by the Office <br />of the State Engineer and proof of this approval is submitted to the Division. <br />2. If the depth of excavation exceeds 16 feet, and excavation is within 200 feet of any <br />significant, valuable, and permanent man-made structures not owned by the Operator, <br />the amount of required mining setback to the structure or right-of-way will be <br />increased as necessary to be two-times the depth of the excavation. <br />3. The total amount of financial warranty required for permit issuance is set at $510,198. <br />Upon the submittal and approval by the Division of a Technical Revision which <br />includes a set of standards and specifications and a quality assurance plan for the <br />lining of the pit the financial warranty will be recalculated. <br />4. The Operator shall mine and backfill the northeast corner of the permit area prior to <br />mining activities in Phase 4.
