<br />Rationale for Recommendation for Approval, Over Objections <br />Regular 112 Construction Materials Permit Application, Timnath Connell Pit, <br />Connell Resources, File No. M-99-050 <br />Submitted April 27, 1999 <br />Introduction <br />On August 31, 1999, the Division of Minerals and Geology (DMG) issued its recommendation <br />for approval of the Timnath Connell Pit, submitted by Connell Resources over one objection. <br />This document is intended to provide a basis for DMG's recommendation over vazious concerns <br />and reasons for objections to this application. <br />The Timnath Connell application was found complete and considered filed with the Division on <br />Apri127, 1999. The application proposes to permit approximately 158 acres for sand and gravel <br />mining of which approximately 144.6 acres will be disturbed in phases by mining. This site is <br />located l mile South of Timnath, Colorado East of Interstate 25 and between Harmony Road and <br />Larimer County Road 36. <br />The application proposes to allow mining below the water table, while dewatering the pit. The <br />Applicant proposes to reclaim the area to a lined water storage reservoir. The Applicant has the <br />option to purchase the property and the substance to be mined. <br />I.Objections: <br />The Division has received only one objection from the following individual during the initial <br />public cottunent period. <br />This objection was received on June 17, 1999 from Mr. Louis Swift, an adjacent property owner. <br />No comments have been received from any other objectors by the Division, either during the public <br />comment period, after the public comment period or during or after the Informal Conference <br />Comment Period. <br />II. ISSUES RAISED BY OBJECTORS: <br />The sole issue raised by Mr. Swift was his concern that the dewatering and lining of the pit would <br />have major adverse effects on the Swift Ponds. <br />ISSUES WITHIN THE JURISDICTION OF THE DIVISION AND BOARD <br />The Division considers issues concerning the quality or quantity of ground water to be within the <br />jurisdiction of the Division and the Board. <br />
