<br />20. ATTORNEYS' FEES. If any action is brought in a court of law by either <br />party to this Lease as to the enforcement, interpretation or construction of this Lease or <br />any document provided for herein, the prevailing party in such action shall be entitled to <br />reasonable attorneys' fees as well as costs incurred in the prosecution or defense of such <br />action. <br />21. NOTICES. All notices and communications required by this Lease shall <br />be in writing shall be sent by certified mail, return receipt requested, to the addresses set <br />below: <br />Owner: 440 North Eleventh Street <br />Gunnison, Colorado 81230 <br />Lessee: Bob Gydesen <br />200 Industrial Pazk Road <br />Gunnison, Colorado 81230 <br />Notice shall be deemed properly given when mailed to the above addresses. Any patty <br />may change its address by giving written notice to the change to the other party in the <br />manner provided above. <br />22. INVALIDITY OR INAPPLICABILITY. If any term, provision or <br />paragraph of this Lease, or application thereof, be invalid or unenforceable, the remainder <br />of this Lease or the application of such terms, provisions and pazagaphs other than that <br />which is held to be invalid or unenforceable, shall not be effected thereby and each of the <br />remaining terms, provisions and paragraphs of the Lease shall be valid and enforceable to <br />the extent permitted by law. <br />23. TIME OF ESSENCE. Time shall be deemed to be the essence of this <br />Lease. <br />24. NON-ASSIGNMENT. The Lessee shall not have the right to assign any <br />of its rights and privileges, duties and obligations hereunder nor any right to sublet the <br />Leased Premises or any portion thereof, without prior written consent of the Owner. <br />Nothing contained herein shall be deemed to obligate the Owner to consent to arty such <br />assignment or subletting, which consent may be withheld by the Owner with or without <br />cause, in Owner's sole discretion. <br />25. BINDING AGREEMENT. This Lease shall be binding upon the heirs, <br />personal represematives, successors and assigns of the parties hereto. <br />6. <br />
