Case #46-92-C <br /> Sand Creek Farms - Page 2 <br /> <br /> Cond itiona Precedent: <br /> 1. Submittal of an approval for mining and reclamation from the <br /> Colorado Mined Land Reclamation Division. Evidence of bonding for <br /> reclamation shall be included with this approval. <br /> 2. Submittal of evidence that the applicant has applied for an NPDES <br /> permit from the Colorado Department of Health. <br /> 3. Submittal of a fugitive dust permit, if necessary, from the Air <br /> puality Division of the Colorado Department of Health. <br /> Sti pulationee <br /> 1. All mining and reclamation activities shall be completed on or <br /> before July 20, 1992. <br /> 2. Washing of materials shall be permitted only if the applicant can <br /> obtain the correct well permits from the Colorado Division of <br /> Water Resources. Prior to any washing activities the applicant <br /> shall submit evidence from the State Engineer that the existing <br />• well has been properly permitted. <br /> 3. No stockpiles of materials shall be allowed within 50 feet of the <br /> centerline of West Bkjou Creek (100' total), and all stockpiles <br /> outside of this area sha•11 be oriented in a north-south direction <br /> so as to not impede and divert flood events. <br /> <br />I 4. Prior to starting of operations and prior to start up of each <br />~ phase, a "Notice to Proceed" shall be obtained from the Adams <br /> County Environmental Compliance Agent so that all conditions pre- <br /> cedent and applicable stipulations can be verified, and so that <br /> reclamation of each previous phase is completed. <br /> S. If traffic becomes excessive on Calhoun-Byers Mile Road, in the <br /> opinion of the Traffic Engineer, the applicant will be required to <br /> dust abate the two miles of gravel road south of 64th Avenue align- <br /> ment. The Adams County Public Works Department reserves the right <br /> to require dust abatement at their discretion. <br /> 6. No excavation shall be allowed within the 100' of the south pro- <br /> perty line and in the event erosion occurs in this 100' area from <br /> flooding events, the operator shall immediately restore said <br /> eroded area after said flood event. <br /> 7. Hours of operation shall be 6:00 a.m, to 10:00 p.m. seven days per <br /> week. If the applicant requires additional hours of operation or <br /> hauling, the Director of the Department of Planning and <br /> Development shall review such pr oposala and shall have authority <br />~~ to authorize changes in hours of operation and hauling upon <br /> finding of no significant impact to surrounding property owners <br /> abutting the site or along the haul route. At the discretion of <br />• the Director. the request may be forwarded to the Board of County <br />' <br /> Commissioners if property owner <br />s concerns are of such signifi- <br />i ~ cance that a public hearing is warranted. <br /> <br /> <br /> <br />
