Clem of me awN <br /> when me tollowle~ promed)ngr, emoo6 oNen were had end done, to-wlt <br /> <br /> ZONING HEARING DECISION - CASE #46-92-C <br /> SAND CREEK FARMS <br /> WHEREAS, on the 20th day of July, 1992, the Hoard of County <br /> Commissioners, held a public hearing on the application of Sand Creek <br /> Farms, Inc., Case #46-92-C, requesting Conditional Use for sand <br /> extraction in the West Bijou Creek drainage, on the following <br /> described property: <br /> Bearings were determined based upon the East line of the SEi of <br /> Section 3, Township 3 South, Range 61 West of the 6th P.M. as <br /> bearing N1°02'E taken from Court re-survey notes dated 9-4-1915 <br />' with S11 other bearings as being relative thereto; Commencing at <br /> a point which bears N84°54'W 830.6 feet from the Southeast corner <br /> of Section 3, T3S, R61W 6th P.M. to the point of beginning, <br /> thence N7°32'E 2571.7 feet to a point which bears S87°38'W 538.4 <br />_ feet from the Ei corner of Section 3, thence 589°10'W 880.7 feet, <br /> thence 53°O1'W 2541.0 feet, thence N89°56'E 677.0 feet to the <br /> point of beginning. <br /> APPROXIMATE LOCATION: Northwest corner of Calhoun-Byers Mile Road <br />• (46N) and 64th Avenue alignment. <br /> WHEREAS, the Adams County planning Commission held a public hearing on <br /> the 9th day of July, 1992, and forwarded a recommendation of approval <br /> to the Board of County Commissioners, based on the following findings <br /> of fact: <br /> 1. The applicant is proposing to mine a portion of his property that <br />' • lies within the 100 year floodplain of West Bijou Creek. The pro- <br /> perty has been previously mined on a small scale, sometime in the <br /> past, without a permit. <br /> 2. If the applicant can abide by the conditions recommended by the <br />~ public Works Department, and obtains all permits associated with <br /> floodplain use, stormwater discharge, and fugitive dust, the pro- <br /> ject would be Iona idered compatible with the surrounding area. <br /> <br /> 3. The applicant's site is located in a sparsely populated area of <br /> the County and ie very rural in character. Amine of this type, <br /> if operated and reclaimed as proposed, would be compatible with <br />i the Zoning Regulations and the Comprehensive Plan. <br /> 4. Information concerning approved mining and reclamation plane from <br /> the Mined Land Reclamation Division, and well permits from the <br />~ Division of Water Res ourcea, is required prior to the start of <br /> mining, and prior to washing any material. If these permits are <br />i obtained, the proposal would be compatible with the Adams County <br /> Zoning Regulations. <br /> 5. ~If the applicant can operate within the proposed mining and recla- <br /> mation plane, as revised, the project would not be detrimental to <br /> • the health, safety, and welfare of the inhabitants of the area, <br /> nor would it deter future quality development of the area. <br /> NOW, TFD:REFORE, HE IT RESOLVED, by the Board of County Commissioners, <br /> County of Adams, State of Colorado, that the application of Sand Creek <br /> Farms, Inc., requesting Conditional Use for sand extraction in the <br /> West Bijou Creek drainage on the above described property, is hereby <br /> approved, subject to the following: <br /> <br /> <br />
