<br /> ,. • • <br /> performed by Lessee, Lessors grant, bargain, lease, let and <br />~ demise unto Lessee the exclusive right and privilege of digging <br /> and taking out clay, gravel and overburden from the following <br /> described real property located in Jefferson County, Colorado: <br /> Township 2 South, Range 70 West, 6th P.M. <br /> Section 3: N1/2, except the south 100 feet <br /> and the east 100 feet thereof; <br /> Section 4: E1/2SW1/9, SE1/4, E1/2NE1/4; <br /> except the south 100 feet of the <br /> E1/25W1/4 and of the SE1/9, and <br /> except the east 100 feet of the <br /> SE1/4; and further excepting all <br /> rights with respect to clay in <br /> the following described lands: <br /> A strip of land 600 £eet in <br /> width being 300 feet on each <br /> side of the center line of <br /> the existing clay pit which <br />runs generally north and <br /> south across the El/25W1/4 of <br /> said Section 4; <br /> all lying southerly of the existing right-of-way line <br /> of Highway 128 and containing 605 acres, more or less; <br /> together with all appurtenances, including the right of ingress <br /> and egress to and from said Leased Premises as may be <br /> <br /> reasonably required in the exercise of the rights and <br /> privileges granted herein. <br /> TO HAVE AND TO HOLD the Leased Premises with its <br /> appurtenances unto Lessee, its successors and assigns from the <br /> date hereof until the 31st day of December, 2007, subject to <br /> <br /> the following terms, conditions and agreements, to-wit: <br />1. Clay. Gravel and Overburden. Lessee shall dig <br />and remove clay, gravel and overburden from the Leased Premises <br />in accordance with approved and lawful methods of doing so. <br />~ -~- <br />
