Exemption from (hese
limitations due to storm events is subject to burden of proof requirements -see section VLA3.6) of previous permit rationale.
a) Antideyradation: Since the receiving waters are Use Protected, an antidegradation review is not required for these
dischargespursuanttosection31.8(2)(b)ofTheBasicStandardsandMethodoloQies or Surface Water. Further, the Division
has determined that the antidegradation presumption was overcome because discharge does not occur during low flow
periods.
b) Whole EffluentToxicity (WET) Testing: Acute WET testing is not required for all the outfalls. Since the mine drainagesource
was eliminatedfrom this permit, and that the new and existing discharges from these outfalls contain surface runoffsolely and
do not contain toxic pollutants in toxic amounts. On this basis, WET testing is not a requirementforthese outfalls. However,
the Division reserves the right to reopen the permtt to include WET testing, should facility conditions change or if new
information becomes available.
B. Monitoring
1. Effluent Monitoring: Effluent monitoring will be required as shown in Tables VI-2.
