COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT, Water Quality Conrol Division <br />Rationale -Page 8, Permit No. CO-0044776 <br />Division records indicate that Bowie Resources, Ltd. has coverage for stormwa[er discharges from the Bowie <br />Mine under a General Srormwater Discharge Permit for stotmwater discharges associa[ed with mehzl minis;; <br />activities, number COR-040078. Stormwarer permitting issues for this faciliry will be handled separately by the <br />Division's Stormwater Unit, although this permit may be reopened at a later date to incorporate st0,rntwater <br />provisions, if deemed appropriate. <br />4. Economic Reasonableness Evaluation: Section 25-8-503(8} of the revised (June 1985) ~olorad Water Oua,fgy <br />Control Act required the Division to "determine whether or trot any or all of the water quality standard based <br />effluent limitations are reasonably related to the economic, environmental, public health and energy impacts to <br />the public and affected persons, and are in furtherance of the policies set for[h in sections 25-8-192 and <br />25-8-104. " <br />The Colorado Dtscharge Permit System Regulations (Regulation No. 61) further define this requirement under <br />61.11 and state: "Where economic, environmental, public health and energy impacu to the public and affected <br />persons have been considered in the classifications and standards setting process, permits written to meet the <br />standards may be presumed to have taken into consideration economic factors unless: <br />a) Anew permit is issued where the discharge was not in existence ar the time of the classification and <br />standards rulemaking, or <br />b) In the case of a continuing discharge, additional information or factors have emerged that were nor <br />anticipated or considered at the time of the classification and standards ru/emaking. " <br />The evaluation for this permit shows that this is a new faciliry nor in existence at the time of water quality <br />standards rulemaking. However, based on available data, the resulting water quality standard-based effluent <br />limitations are determined to be reasonably related to the economic, environmental, public health, and energy <br />impacts to the public and affected persons. If the permirtee disagrees with this finding, pursuant to 6.12. D(2) i7~) <br />the permtttee should submit all pertinent information to the Division during the public notice period. <br />B.
