<br /> <br />acre feet per year and since the reservoir rights temporarily assigned to the <br />Tucker Construction Company by Mr. Holtzinger amount to more than 129 acre <br />feet per year, this would appear to provide an appropriate contingency plan for <br />tF,e supply of wash and dust abatement water for the operation. <br />In the mining plan a sedimentation pond diversion ditch and two dams <br />ar•e provided. Evaporative loss from the sedimentation pond can be made up <br />either from the deep well or from Mantey Reservoir water rights. The pond <br />is: to be left in place after the mining operation is complete as a stock <br />pnnd at the request of the landowner, Terry Grazing Association. Colorado <br />s~~atutes do not require that evaporative losses from stockwatering ponds be <br />augmented. <br />The dams to be used fo.r the settling pond and diversion will be less <br />than 10 feet in height and, therefore, are not sub,~ect to Article 87 of Title <br />37 of the 1973 Colorado Revised Statutes. <br />
