Given what was stated under Exhibit "D" the <br />statement is a bit confusing. In order for the Division to properly calculate the <br />required financial warranty for the total maximum affected acres, the Division <br />need a detailed break down of acres as Major, Moderate and Minor disturbances in <br />acres. Pleas provide the breakdown as requested. <br />E) It is the understanding of the Division that the operator has agreed to the seed <br />mix approved by the local USDA Soil Conservation District. <br />F) Based on the soils map, the operator must commit to place an average of 9 inches <br />of top soil/ growth medium through out the affected acres. <br />G) Even though the financial warranty calculations will address the cost of weed <br />control plan, your discussions did not address how you plan to control noxious <br />weeds from infesting the reclaimed acres. Please briefly discuss how you plan to <br />mitigate noxious weed infestation, if it becomes a problem. <br />IV) Exhibit "G' Water Information <br />A) The operation does not plan to expose ground water. However there are a few PVC <br />water pipelines crossing the permit area which supply water to a small stock pond <br />and small watering troughs south and east outside of the proposed permit area. In <br />addition there are some what appeared to be collection ditches along the county <br />road. The operator must obtain signed notarized written agreement between owners <br />of these structures or must commit to stay 200 feet away from these structures. <br />V) Exhibits, H, I, J &K Adequate. <br />VI) Exhibit L Reclamation cost <br />A) Please provide the information requested under Exhibits & B, so the Division can <br />calculate the required warranty for the total maximum affected acres and provide <br />you with the breakdown of the cost. <br />VII) Exhibits M, N, O, P & Q Adequate adequate. <br />VII) Exhibit "S" Permanent man made structures. <br />A) In lieu of an engineering study to show that all man made structures with in 200 <br />feet of the permit area will not be impacted by the proposed operation, pleases <br />provide a notarized agreement from owners of such structures located with in the <br />permit area, such as fences, water pipe lines, ditches, scale house, etc. etc. <br />There is a signed notarized agreement included with the application.
