Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed your 112 permit application and has the following comments. <br />The application proposes to permit a total of 282 acres. Of which 32 acres are through <br />the incorporation of two 111 permits, M-1997-042 & Id-1998-081. The area also consists <br />of some pre- law affected acres that will be mined and reclaimed under the proposed 112 <br />application. <br />I) Exhibit "A", "B" &"C". Adequate. <br />II) Exhibit "D" Mining plan. <br />A) Under the mining plan you stated,"a total of 7 phase areas are planned to mine <br />200 acres maximum planned acres". However, your Exhibit "C" MINING PLAN MAP shows <br />a total of 250 acres in seven phases. Does it mean the rest of the acreage that <br />includes the two 111 permits will not be mined but will be used as staging and <br />only reclamation activities? Please explain. <br />B) The applicant states," the maximum affected area will be 25 acres. xowever, under <br />Phase I, the applicant proposes to affect 30 acres in addition to the per-law <br />disturbance of 30 acres, which is being proposed to be mined and reclaimed. <br />Please explain. <br />C) On the next page, the applicant states, "Only 10 aces or less will be disturbed <br />in the subsequent phase Acres #2-7.It is a bit unclear if the operator is going <br />to affect a maximum of 10 acres in phases 2 thru 7. If such is the case, does the <br />10 acres include the 5 acres of staging area proposed for each phase? Please <br />explain. <br />D) It is the understanding of the Division that this will be a dry operation and <br />only screening and crushing will be the only activities that will be performed on <br />site. <br />III) Exhibit "E" Reclamation Plan <br />A) The applicant states," reclamation will be concurrent and limited to a maximum of <br />10 acres disturbance in all phased acres. Please refer to item "D" under the <br />above exhibit. <br />B) Under the reclamation plan you stated that"all phased areas will be mined as <br />fully as possible from one area to the next leaving a uniform slope & topography <br />and slope across phase area boundaries". Does it mean then in Phase #s 2 thru 7, <br />with the exception of the five acres staging areas, all the additional acres will <br />be mined. If such is the case, the amount of acres affected by mining will be <br />more than 10 acres for each phase. Pleas explain. <br />C) The applicant states,"spur roads will be graded on the original surface into the <br />separate phase areas as necessary from the existing site road.
