Section 816.10u (b) Continued. <br />• reclamation operations subject to this permit application. <br />Therefore, Section 816.104 (b) is not applicable. <br />Section 816.105 Backfilling and grading: Thick overburden. <br />(a) The provisions of this Section apply only where the final thickness <br />is greater than 1.2 of the initial thickness. Initial thickness is the <br />sum of the overburden thickness and coal thickness prior to removal of <br />coal. Final thickness is the product of the overburden thickness prior <br />to removal of coal, times the bulking factor to be determined for each <br />mine plan area. The provisions of this Section apply only when surface <br />mining activities cannot be carried out to comply with Section 816.101 <br />to achieve the approximate original contour. <br />Energy Fuels does not have a thick overburden situation. The final <br />thickness is less than 1.2 of the initial thickness as demonstrated <br />• under Section 816.101 (a)(3). Typical values for the Eckman Park <br />reserve range from 1.01 to 1.17. These values are derived from <br />computations set forth under Section 816.101. For further information <br />see Eckman Park Wadge and Lennox Coal Seam Isopachs (P]ap 55) and <br />Eckman Park Geology (Piap S). <br />(b) In surface mining activities where the volume of spoil over the <br />mine clan area is demonstrated to be more than sufficient to achieve the <br />approximate original contour, surface mining activities shall be con- <br />ducted to meet, at a minimum, the following standards-- <br />• <br />(4) Yaul or convey, backfill, grade, an3 revegetate wastes and excess <br />spoil to achieve an ecologically sound land use approved by the regu- <br />latory authority as compaticle with the prevailing land uses in unmined <br />areas surrounding the mine elan area. <br />(5) Eliminate all highwalls and depressions by Backfilling with spoil <br />816-135 <br />
