Section 816.103 (b) Continued. <br />• discussion on this topic is presented in Section 779.14 (b)(1)(iv). <br />Specific data are presented in Table 108, Results of Analysis on <br />Overburden and are statistically described in Table 4, Statistical <br />Description of Overburden Chemical Data. The potential of solute <br />leaching is discussed in Section 780.21 (c). <br />In summary, no elements exist in the overburden in concentrations <br />that would create any toxicit}• problems created b}• leaching. <br />Therefore, no selective placing or special handling of spoil <br />material will be necessary. <br />Section 816.104 Backfilling and grading: Thin overburden. <br />(a) The provisions of this Section apply only where the final thickness <br />is less than 0.8 of the initial thickness. Initial thickness is the sum <br />of the overburden thickness and coal thickness prior to removal of coal. <br />• Final thickness is the product of the overburden thickness prior to re- <br />moval of coal, times the bulking factor to be determined for each mine <br />plan area. The provisions of this Section apply only when surface <br />mining activities cannot be carried out to comply with Section 816.101 <br />to achieve the approximate original contour. <br />Energy Fuels does not have a thin overburden situation. The final <br />thickness is greater than 0.8 of the initial thickness as demonstrated <br />in Section 816.101 (a)(3). Typical values for the permit area <br />range from 1.01 to 1.17. These values were arrived at Lhrough a <br />range of representative computations in the discussion under <br />Section 816.101.
